1. Agreement to Terms

Welcome to Plato ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our digital ordering platform, accessible via our website (`theplato.in`) and any associated applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Our Role and Service Description

Plato is a technology platform that acts as an intermediary, connecting customers ("Customers") with independent food stall operators ("Stalls") in food courts. Our Service allows Customers to view menus, place orders, and make payments directly to the Stalls.

Important: Plato is not a restaurant, food vendor, or seller of goods. The Stalls are independent businesses responsible for their own operations, including the preparation, quality, and safety of the food they provide. We are not responsible for the food or services provided by the Stalls.

3. Orders and Payments

When you place an order through our Service, you are entering into a contract directly with the Stall. All payments made through the Service are processed by a third-party payment gateway and are transferred directly to the respective Stall's account. Plato facilitates this transaction but is not a party to it. Any issues related to payment, refunds, or order quality must be resolved directly between the Customer and the Stall.

4. User Responsibilities

As a user of our Service, you agree to:

  • Provide accurate and current information for your orders (e.g., name, contact details).
  • Use the Service in compliance with all applicable laws and regulations.
  • Treat Stalls and their staff with respect.
  • Not use the Service for any fraudulent or unlawful purpose.

5. Limitation of Liability

To the fullest extent permitted by law, Plato shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties.
  • Any content obtained from the Service.
  • The quality of the food or services provided by the Stalls.

6. Indemnification

You agree to defend, indemnify, and hold harmless Plato and its employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not to limited to attorney's fees), resulting from or arising out of your use of and access to the Service, or a breach of these Terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
